TERMS AND CONDITIONS FOR ENTRY INTO SPD BREAKING BARRIERS VIRTUAL RUN 2017 EVENT
These terms and conditions apply to SPD Breaking Barriers Virtual Run 2017 organised by SPD (UEN No. S64SS0052D) with its registered place of business at 2 Peng Nguan Street, Singapore 168955 (“we”, “our” or “us”). They consist of:
(a) the general terms and conditions here and set out in Section A that apply to your participation in the SPD Breaking Barriers Virtual Run 2017 as well as all activities (including entering the run and/or participation in lucky draws and contests) associated with the same (“General Terms”). The General Terms apply to your access, browsing, use and participation in the SPD Breaking Barriers Virtual Run 2017 microsite (the “Web Site”); and
(b) the terms and conditions set out in Section B that apply, in addition to the General Terms, if you register for and participate in the SPD Breaking Barriers Virtual Run (“Run Terms”); and
(c) the terms and conditions set out in Section C that apply, in addition to the General Terms, to your participation in the social media contest for SPD Breaking Barriers Virtual Run (“Contest Terms”);
which are together referred to as the “Agreement”. You are treated as having accepted the terms and conditions in the Agreement upon your registering to participate in the SPD Breaking Barriers Virtual Run, regardless whether you register via the Web Site or manually.
Section A – General Terms
1. Postings supplied by you
1.1 The Web Site may link to our Facebook page or other features on the Web Site which may provide some areas where you can post or exchange information, ideas and opinions as well as post photos and other materials. Such actions are collectively referred to as “Postings”. If you make use of this facility you must comply with the terms set out in this Agreement and any applicable terms (including any which may be imposed by the operators of Facebook).
1.2 The standards set out in this clause 1.2 apply to all Postings. You must comply with the spirit and the letter of the following standards. The standards apply to each part of any contribution as well as to its whole.

You warrant that all of your Postings do comply with the standards set out in this clause 1.2, and you will be liable to us and indemnify us for any breach of that warranty.
1.3 You hereby authorise us to copy and use and/or authorise others to use all or part of your Postings in any manner, format, or medium that we or such other parties see fit throughout the world including, without limitation, for the purposes of:
1.4 We have the right to disclose your identity to anyone who alleges that your Posting may infringe their intellectual property rights or their right to privacy.
2. Monitoring and moderating
2.1 Please be aware that we have no obligation to (and do not always exercise) editorial control over Postings or other information that users post to or through the Web Site and such information does not necessarily reflect our views.
2.2 Notwithstanding clause 2.1, we reserve the right to monitor and/or moderate all Postings and to remove all or part of any which we consider in our absolute discretion to be offensive or otherwise in breach of this Agreement. We may also make alterations to Postings at any time and at our discretion.
3. Disclaimer and liability
3.1 Whilst we make every effort to ensure the accuracy of our Web Site and any content, we do not warrant that the Web Site and any materials accessible via the Web Site will be error or omission free.
3.2 We do not accept any responsibility for any use made of the Web Site and we shall not be liable for any other loss suffered in connection with the use of our Web Site or any content to the fullest extent that we may exclude or limit such liability under applicable law.
4. Your personal information
5.1 We may revise the terms of the Agreement at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you.
5.2 We shall be the sole authority to interpret the Agreement and we may take into account the interest of all affected participants. Our decision on all matters relating to the SPD Breaking Barriers Virtual Run 2017 event and these terms and conditions shall be final.
6. Linking to our Web Site
6.1 You may link to our home page or any other relevant page of our Web Site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
6.2 You must not establish a link from any web site that is not owned by you.
6.3 Our Web Site must not be framed on any other site. We reserve the right to withdraw linking permission without notice.
7. General terms
7.1 We will not be liable to you for any breach of the Agreement that arises because of any circumstances which we cannot reasonably be expected to control.
7.2 You shall fully indemnify and hold us harmless from and against any loss, damage, cost, liability or expense (including legal fees), whether direct or indirect, which we incur in respect of, in connection with and/or arising from your breach of the Agreement
7.3 No term of the Agreement is enforceable under the Contracts (Rights of Third Parties) Act (Cap 53B) by a person who is not a party to this agreement.
7.4 If there is a conflict or inconsistency between any provision contained in these General Terms and the Run Terms and/or the Lucky Draw Terms and/or the Contest Terms, except where provided to the contrary, to the extent of the conflict or inconsistency the following order of precedence shall apply:
(i) if you enter the virtual run, the Run Terms will take precedence over all other clauses of the General Terms; and
(ii) if you are participating in the thematic challenge and lucky draw, the Lucky Draw Terms will take precedence; and
(iii) if you are participating in the social media contest, the Contest Terms will take precedence.
Section B – Run Terms
1. Run entry, Eligibility and Registration
1.1 SPD Breaking Barriers Virtual Run 2017 (“Run”) shall be held from 24 November 2017 (0:00am) to 10 December 2017 (23:59pm) GMT+08. By completing the registration form, you are agreeing to enter the Run and signifying that you agree to abide by these Run Terms, the General Terms and the terms set out on the Web Site.
1.2 The Run is open to all persons who are resident in Singapore and residing in Singapore at all times during the SPD Breaking Barriers Virtual Run 2017 event.
1.3 Children should be accompanied and closely supervised by a responsible adult at all times.
1.4 We have the sole discretion to exclude any person from participating in the Run without prior notice nor obligation to furnish reasons
1.5 Registration for the Run closes when run participation reaches the stated capacity or 8 December 2017 (23:59) GMT+08, whichever is earlier as stated on the Web Site. Any extension of registration deadline will be announced and communicated via the Web Site, Facebook and Instagram
1.6 Entries to the Run is strictly non-transferable. Participation in the Run is personal to you; you are strictly prohibited from swapping, selling or transferring or offering to sell, swap or transfer your place in the Run.
2. Registration fees and no-cancellation
2.1 You must pay the registration fee at the time of registering for the Run.
2.2 Registration is deemed complete when payment is successfully made and accompanied by a duly completed registration form.
2.3 Once registration has been duly processed, there will be no fee refund for participants who do not eventually take part in the Run for whatever reason.
3. Participation in the Run is at your own risk
3.1 You are responsible for ensuring that you have undertaken any necessary preparation and training to enter and participate in the Run. You warrant to us that you will be sufficiently fit and healthy to participate in the Run unaided and in accordance with the Agreement. If you are in any doubt we recommend that you seek medical advice.
3.2 You shall not, to the fullest extent permitted by law, hold us responsible for any death or injury, loss or damage, sustained or suffered as a result of your participation in the Run.
4. Run completion
4.1 You will be treated as having completed the Run if you complete registration and submit the required and satisfactory evidence of your completion of the Run to us by the date specified on the Web Site and in these Run Terms. Examples of the required evidence are stated on the Web Site. Any question as to whether registration is complete or evidence sufficient will be determined solely at our discretion. Whilst we will make our best endeavours to notify you of any requirements that have not been met such as non-payment or insufficient distance clocked, we are not obliged to do so. Please therefore ensure you read the instructions and terms and conditions relating to the Run carefully to avoid disqualification.
4.2 You will be entitled to a medal upon completion of the Run. We will send you or make available for your collection, the medals during the times stated on the Web Site. It is your responsibility to ensure that your address and any other details are correct and we will not be responsible or liable to you if these details are incorrect.
4.3 The closing date for submission of proof of run is 10 December 2017 (23:59) GMT+08. If we do not receive satisfactory proof of run before the closing date, you will not be eligible to receive the medal.
4.4 We reserve the right to limit and/or refuse registration/entry to the Run without assigning any reason or giving notice.
5. Postponement or Cancellation
5.1 We reserve the right to cancel or postpone the Run and all activities relating to the SPD Breaking Barriers Virtual Run 2017 event at any time without prior notice, in which case we will make reasonable efforts to inform you of the cancellation or postponement prior to the date of the Run. If the Run is cancelled or postponed, no refund shall be made and we will not be liable for any loss or inconvenience caused.
6. Personal Information
6.1 For the purposes of this Section B, personal information includes any data or information about you (which includes your name, photographs, voice/ video recordings, medical data and other information about you) (“Personal Information”). References in clause 6 to our partners includes our sponsors, vendors, contractors, advertising agencies, third party media entities, and any other third parties with which we may work in connection with the operation of the Web Site and the organisation and promotion of the Run and the SPD Breaking Barriers Virtual Run 2017 event.
6.2 You agree that the Personal Information relating to you can be stored, used by us and our partners in connection with the organisation, staging and administration of the Run and the SPD Breaking Barriers Virtual Run 2017 event.
6.3 You agree that the Personal Information relating to you may be anonymised and the anonymised data may be used by us and our partners in connection with the compilation of statistical information.
6.4 You agree that the Personal Information relating to you can be used by us and our partners for the purposes of:
(i) processing your participation in the Run and the SPD Breaking Barriers Virtual Run 2017 event; and
(ii) sending you information, news and any other form of communication relating to our programmes, services and events; and
(iii) the promotion and marketing of the Run, the SPD Breaking Barriers Virtual Run 2017 event and the Web Site; and
(ii) adding you to a mailing list to keep you informed about any future events and services which we believe you might be interested in, such as similar activities or activities relating to similar types of events; and
(iv) promotional and marketing material in respect of similar events, other community based activities organised by us and/or our partners; and
(v) promotional and communication materials disseminated through various channels and platforms for publicity, marketing and distribution to our partners. These may be in the form of newsletters, annual reports, corporate website and social media; and
(vi) statistical and planning purposes.
6.5 If you would not like us or our partners to use the Personal Information other than for purposes related to your participation in the Run, please email us at firstname.lastname@example.org.
6.6 In particular in relation to photographs, you agree to the publication of such photographs and their use by us and our partners in any way which we may see fit now or in the future including but not limited to display on the Web Site and inclusion in other publications and publicity materials.
Section C – Social Media Contest
1.1 The SPD Breaking Barriers Virtual Run Social Media Contest (“Contest”) is open to all participants who have successfully completed the Run and are qualified to receive the medal.
1.2 A person who is eligible to participate in the Contest per clause 1.1 shall upload a photograph of his participation in the Run onto his personal Facebook or Instagram account and set his personal Facebook or Instagram account to public.
1.3 Our employees, their immediate family members, our vendors, contractors or partners (including but not limited to advertising agencies) or any other individuals directly involved or connected to the Contest and individuals who do not reside in Singapore are not eligible to participate in the Contest.
1.4 We have the sole discretion to exclude any person from participating in the Contest without prior notice or obligation to furnish reasons.
2.1 The Contest is open from 24 November 2017 to 10 December 2017, both dates inclusive and we shall select three (3) winners with the three (3) highest number of likes for photographs that are uploaded on their personal Facebook or Instagram account.
3. Conduct of Contest & Prizes
3.1 The prize for the Contest is set out below:
3.2 There shall be three (3) winners for the Contest and they will be selected based on the number of likes entered against the photograph submitted to us for the Contest and that is uploaded on their personal Facebook or Instagram account.
3.3 The prizes are not transferable nor exchangeable for cash or any other items or goods and services. We will not entertain any request for the exchange of prizes.
3.4 Any terms and conditions set by the sponsors of the Contest prizes and the Run shall apply to the Contest.
3.5 We may, in our sole and absolute discretion and without prior notice or assigning any reason, withdraw, change or substitute any prizes with another of similar value.
3.6 The images of prizes on all marketing materials are for illustration purposes only. Actual products may be different from the images shown.
3.7 The prizes are provided on an “as is”, “with all faults” and “as available” basis. We do not warrant, represent or guarantee the usability or quality of the prizes, or that the claims made by the manufacturers, distributors and/or service providers of the prizes are accurate. To the fullest extent permitted by the law, we disclaim all warranties (whether express or implied) including but not limited to warranties that the prizes will meet the prize winners’ requirements, warranties of satisfactory quality, warranties of merchantability or fitness for a particular purpose. All warranty claims with regard to a prize shall be directed to the applicable manufacturer/service provider and not to us.
3.8 The winners of the Contest shall be announced through our social media platforms and notified by us through the contact number or email address provided by the winners in their registration for the Run.
4. Prize Collection
4.1 The winners must claim their prizes between 18 December 2017 to 12 January 2018, Mondays to Fridays (except Public Holidays) between 9am to 5pm at SPD Ability Centre (2 Peng Nguan Street, SPD Ability Centre, Singapore 168955). All prizes remaining unclaimed by 5pm on 12 January 2018 for any reason whatsoever shall be forfeited and disposed of at our sole discretion and no resulting claims whatsoever (whether for prize, payment or compensation) shall be entertained.
4.2 The winners must produce the necessary proof of identity as we may require e.g. NRIC or work permit pass, original registration receipt, etc, which should correspond with the winners’ Contest entry. Any misrepresentation of any fact or particulars (which we deem material) shall result in disqualification and/or forfeiture, withholding, withdrawal or reclaiming of any prizes won.
4.3 Winners below 21 years of age shall be accompanied by a parent or guardian during prize collection and the parent or guardian shall acknowledge receipt of the prize on behalf of the minor.
5.1 We reserve the right to video, photograph and/or record a winner’s name, image, voice and details and to use, display, reproduce, publish, adapt or modify the recordings, photographs and like personal information taken in connection with or arising from the Contest, for publicity of the Contest and the Run without having to pay any fee or compensation to the winner.
5.2 We reserve the right to cancel the Contest and to amend or change the terms and conditions under this Section D at any time for whatever reason and without giving prior notice to the participants. Any such change to the terms and conditions shall take effect immediately and shall bind all participants of the Contest including those who have submitted entries before the date of the change.
5.3 Our decision regarding the award of all prizes, and/or in every situation including any not covered in this Section D, shall be final and binding on all participants of the Contest, and no queries, challenges or appeals may be made or entertained regarding our decision on the same. The receipt by any winner of any prize in this Contest is conditional upon compliance with any and all applicable laws, rules and regulations.
5.4 We shall not be liable in any way and shall be indemnified and held harmless, fully and effectively, by each participant entering the Contest and upon winners accepting the prizes, against and from any and all claims by any participant, winner or third party for any injuries, losses or damages to property or person of any kind in respect of, in connection with and/or arising from participation in the Contest or the acceptance, possession, use or misuse of the prizes.
